The Appeals Court has thrown out an appeal against a court decision to annul a police decision banning an officer from running in the 2021 parliamentary elections, it announced on Tuesday.
The ruling of the Appeals Court was made on March 13.
A police officer had requested leave to run for MP in 2021. Although the police initially said he could, a written reply denied him the right to do so due to conflict of interest.
In April 2021, the court of first instance said the police officer’s complaint was founded and annulled the police decision, deeming it did not comply with the Constitution.
The appellant said the court of first instance had wrongly annulled the police decision.
However, the Appeals Court said the Constitution did not allow for the addition of any precondition and thus rejected the police appeal.
The Appeals Court ordered the appellant to pay €3,000 plus VAT in damages to the respondent and all legal expenses.
