The Nicosia criminal court on Wednesday postponed until April 2 the case brought against a German real estate agent charged on 44 counts related to the usurpation of Greek Cypriot property in the north.

The court adjourned to determine which of those issued would be part of a trial within a trial, requested over the legality of specific evidence to be used by the prosecution and the procedure by which the suspect was arrested and the alleged violation of the right to a lawyer.

On behalf of the prosecution, Anna Mattheou said the evidence to be used included the suspect’s mobile telephone, an external disc drive, a tablet and various documents, some of which were not related to the arrest but were found in the process of investigations.

Defence lawyer Soteris Argyrou submitted the framework for the trial within a trial, questioning the legality of evidence and saying the prisons had refused to provide necessary medication to his client since December.

Court president, judge Nicholas Georgiades decided to postpone the case till April 2, to determine which issued would be included in the trial within a trial.

He furthermore said the court did not have the authority to intervene in the issue with the prison.
The defence raised the issue of the defendant’s health.

The defendant will remain in custody until the next hearing.
